By accessing or using SeismicCert AU ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users, including builders, certifiers, and administrators.
SeismicCert AU is a software-as-a-service (SaaS) platform that facilitates the management and documentation of seismic compliance certification under AS 1170.4-2007 and the National Construction Code (NCC). The Platform connects builders and developers with accredited certifiers for the purpose of reviewing structural documentation and issuing compliance certificates.
SeismicCert AU is a workflow and document management tool only. It does not provide engineering advice, structural assessments, or professional certification services. All certification decisions are made exclusively by the accredited certifiers engaged through the Platform.
You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information current.
Certifiers must hold current, valid accreditation from a recognised Australian accreditation body. By registering as a certifier, you warrant that you hold the required qualifications and licences to perform seismic compliance certification in the states you nominate.
Certifiers access the Platform under a paid subscription. Subscription fees are charged in Australian Dollars (AUD) and are non-refundable except as required by the Australian Consumer Law. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
Builder access to the Platform is provided free of charge. SeismicCert AU reserves the right to introduce fees for builder services with 30 days' written notice.
All content, software, trademarks, and materials on the Platform are owned by or licensed to SeismicCert AU. You may not copy, reproduce, distribute, or create derivative works from any Platform content without express written permission.
You retain ownership of all documents and materials you upload to the Platform. By uploading content, you grant SeismicCert AU a limited, non-exclusive licence to store, process, and display that content solely for the purpose of providing the service.
To the maximum extent permitted by law, SeismicCert AU is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of profits, data loss, or building defects arising from reliance on certificates issued through the Platform.
SeismicCert AU's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you to SeismicCert AU in the 12 months preceding the claim.
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
SeismicCert AU may update these Terms from time to time. We will notify registered users of material changes by email or in-platform notification at least 14 days before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
